That an action has been commenced and is now pending in this Court to foreclose on the real property (the “Property”) described in the Complaint and commonly known as 215 Emerald Way, Spartanburg, SC 29302.

That the Plaintiff, therefore, made John Doe, Jane Doe, Richard Roe, and Mary Roe, the same being fictitious names used as the true names of such persons as are unknown to the Plaintiff, Defendants, as representatives of all unknown persons claiming any right, title, interest and estate in, or lien upon the real and personal property involved in this action; and that some of the unknown Defendants are or may be minors or under other legal disability or in the military service.
That in order that all persons who may have some interest in the Property may be brought before this Court, all such unknown persons have been named as Defendants, of which all unknown adults being a class designated as John Doe and Jane Doe, and all unknown minors or persons under other legal disability or in the military service being a class designated as Richard Roe and Mary Roe; and it is necessary that some discreet, competent person be appointed to represent such unknown persons unless such persons or someone on their behalf should apply to the Court for such an appointment.

That in order that all persons who may have some interest in the Property may be brought before this Court, all such unknown persons have been named as Defendants, of which all unknown adults being a class designated as John Doe and Jane Doe, and all unknown minors or persons under other legal disability or in the military service being a class designated as Richard Roe and Mary Roe; and it is necessary that some discreet, competent person be appointed to represent such unknown persons unless such persons or someone on their behalf should apply to the Court for such an appointment.
That William Henry Burriss, Esquire is a suitable and proper person to be appointed Guardian ad Litem Nisi for said Defendants, resident or non-resident, who may be adults or minors or under other legal disability, or in the military service, and is in no way connected in business with the Plaintiff or its counsel and has no interest adverse to the interest of such minor Defendants, Defendants under other legal disability, Defendants in the military service, and other unknown Defendants claiming any right, title, or interest in the Property.
NOW, THEREFORE, IT IS ORDERED that pursuant to Rule 17, SCRCP, William Henry Burriss, Esquire, be, and hereby is, appointed Guardian ad Litem Nisi on behalf of all unknown minors; all unknown persons under other legal disability; all unknown Defendants in the military service; and all other unknown Defendants, all of whom may have or may claim to have some interest in or claim to the Property.
IT IS FURTHER ORDERED that William Henry Burriss, Esquire  is empowered and directed to appear on behalf of and represent said Defendants unless said Defendants, or someone on their behalf, shall, within thirty (30) days after service of a copy hereof, as directed, procure the appointment of a Guardian or Guardians ad Litem for said Defendants.
