NOTICE OF APPLICATION.  Notice is hereby given that LAKE BOWEN SOCIAL CLUB, intends to apply to the South Carolina Department of Revenue for a license/permit that will allow the sale and on premises consumption of  BEER/WINE/LIQUOR at 8390 HIGHWAY 9, INMAN, SC 29349. To object to the issuance of this permit/license, written protest must be received by the S.C. Department of Revenue no later than December 19, 2008.
For a protest to be valid, it must be in writing, and should include the following information:
(1)  the name, address and telephone number of the person filing the protest;
(2)  the specific reasons why the application should be denied;
(3)  that the person protesting is willing to attend a hearing (if one is requested by the applicant);

By virtue of a decree heretofore granted in the case of Branch Banking and Trust Company of South Carolina, Plaintiff, vs. D & D Transport, Inc., American Underwriting Service, Inc., and United States of America, through its agency, Department of the Treasury, Internal Revenue Service, Defendants,

I, the undersigned Special Referee, will sell on Monday, January 5, 2009, at 11:00 o’clock A.M., at the Newberry County Courthouse, Newberry, South Carolina, to the highest bidder, the following described property, to wit:

PARCEL A

All that certain piece, parcel or tract of land, together with any improvements thereon, situate, lying and being in the State of South Carolina, County of Newberry, Tax District No. 1OS, containing 3.26 acres, more or less, comprised of three lots and being more particularly shown on a plat of a survey as Parcel 8-R consisting of 1.22 acres, and as Parcel 9-R consisting of 1.30 acres, and as Parcel 10A-R consisting of 0.74 acres, by Foard H. All that certain piece, parcel or tract of land, together with any improvements thereon, situate, lying and being in the State of South Carolina, County of Newberry, Tax District No. 1OS, containing 1.138 acres, more or less, and being more particularly described on a plat of a survey by Foard H. Tarbert, Jr., dated April 25, 1996, and recorded in the Office of Clerk of Court for Newberry County, on May 23, 1996 in Plat Book 4, at page 545, said plat being incorporated herein by reference.

SUBJECT TO that 40’ right of way non-exclusive easement for use of the road for ingress and egress, along the northern and eastern boundary lines of subject property, and shown on that plat herein mentioned above, and being more particularly described in that deed, dated November 20, 1987, and recorded in the Office of the Clerk of Court for Newberry County in Plat Book 273, at page 119.

This tract, TMS No. 339-2-42, is the identical property conveyed to D&D Transport, Inc., by Deed of William P. Hendrix, dated May 21, 1996, and recorded in the office of the Clerk of Court for Newberry County on May 23, 1996, in Deed Book 437, at page 146.

TERMS OF SALE:  FOR CASH:  The successful bidder, other than the Plaintiff, will deposit with the Special Referee, at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of non-compliance.  If the Plaintiff’s representative is not in attendance at the scheduled time of sale, the sale shall be cancelled and the property sold on some subsequent sales day after due advertisement.  Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent sales day (at the risk of the highest bidder).  Purchaser to pay for preparation of the deed, documentary stamps on the deed, and recording of the deed.  The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance at the legal rate established for judgments.  Subject to assessments, Newberry County taxes, easements, easements and restrictions of record, and other senior encumbrances.
