Solicitor: Negligence not enough for criminal case in Cleveland Park accident

There will be no criminal charges filed in connection with the March 19 train crash in Cleveland Park that killed one child and injured 28 others, Spartanburg Public Safety Director Tony Fisher announced Tuesday.
The responsibility of determining whether charges would be filed was passed to the Ninth Circuit Solicitor’s Office serving Charleston and Berkeley counties, and Solicitor Scarlett Wilson said in a letter, which Fisher provided the media, that in her opinion it would be impossible to prove conductor Matthew Mark Conrad acted with reckless disregard for the safety of the train’s passengers.
Fisher explained that although speed was determined to be the ultimate cause of the accident, the investigation also determined that weight distribution contributed.
He said it appeared there was more weight on the right side of the train as most of the parents sat on that side. The train rolled in that direction as it went into a curve.
