Final approval
expected in Senate

A proposal that would empower South Carolina law enforcement agencies to check residency status on suspected illegals already in custody appears poised for approval by the state Senate this week as the General Assembly reconvenes to finish up several items of business.
The proposal is patterned after the controversial Arizona law that allows law enforcement officers there to detain people suspected of being in the country illegally but which has been challenged by several groups in federal court.
The significant difference between Arizona’s law and the one proposed for the Palmetto State is South Carolina’s proposal would only allow law enforcement to check the residency status of suspects already in custody on other charges.
Rep. Rita Allison, R-Lyman, said the House has amended the immigration law passed in 2008 to provide funding for law enforcement agencies to check residency status and to underwrite the deportation process for persons discovered to be here illegally. She also said the House’s proposal focused on those aspects that have been upheld by the Supreme Court.
